Sailing Meisol

GENERAL TERMS
& CONDITIONS

These General Terms and Conditions (“GTC”) govern the relationship between Sailing Meisol GmbH (“Sailing Meisol”), Company Number: CHE-198.260.080, and the Participant, as identified at the time of reservation.

1. Registration & Contract Formation
1.1. By registering for a sailing trip, the Participant agrees to these GTC. This applies even if booking through a third-party company.
1.2. Registration constitutes an offer to conclude a contract, which becomes binding when Sailing Meisol sends a booking confirmation.
1.3. Full payment or at least 30% must be made upon receipt of the invoice to complete the reservation. Failure to pay within 30 days of invoice issuance may result in automatic cancellation.
1.4. For bookings via third-party companies, the contract is considered concluded when Sailing Meisol issues a confirmation email. The payment terms of the third-party provider apply in such cases.

2. Services & Inclusions
2.1. The scope of services is as described on www.sailing-meisol.ch, including accommodation, use of onboard facilities, bed linen, final cleaning, crew (skipper and hostess), meals on board, port fees, fuel, and water. Alcohol is not included.
2.2. Sailing Meisol may modify the itinerary, departure, and arrival ports due to seafaring conditions. If changes occur, Sailing Meisol will inform the Participant promptly.
2.3. Travel to/from the departure point is not included and must be arranged by the Participant at their own expense.

3. Trip Duration & Schedule
The sailing trip starts Saturday at 16:00 and ends Friday at 10:00.

4. Payment Terms
4.1. Sailing Meisol will issue an invoice upon contract confirmation.
4.2. Full payment or at least 30% is due within 30 days of invoice issuance.
4.3. If payment is not received, Sailing Meisol reserves the right to cancel the booking.
4.4 If the reservation was made with a 30% payment, the Participant has to pay the remaining 70% at least one month before departure.
4.5 If payment is not received, Sailing Meisol reserves the right to cancel the booking and keep the 30% fee.
4.4. When booking through a third-party provider, their payment terms apply, but Sailing Meisol’s cancellation and liability terms remain in effect.

5. Participation Requirements & Safety
5.1. Sailing is a physically demanding activity. By registering, the Participant confirms they are in suitable health and can stay afloat in water for at least 20 minutes.
5.2. Any medical conditions (e.g., diabetes) must be disclosed to the skipper at the start of the trip.
5.3. The skipper has full authority over all sailing, nautical, and navigational decisions. The Participant agrees to follow all safety instructions.
5.4. Legal guardians are fully responsible for supervising children onboard.

6. Cancellation & Refund Policy
6.1. The Participant may cancel at any time before departure.
6.2. Refund policy:

  • More than 30 days before departure: 70% refund, 30% retained as cancellation fee.
  • 30 days or less before departure: No refund.

6.3. If the sailing trip cannot take place due to unavoidable and extraordinary circumstances (force majeure), such as war, natural disasters, pandemics, government restrictions, or extreme weather conditions, Sailing Meisol is not responsible for any resulting cancellations. In such cases, no refunds will be issued.

7. Termination by Sailing Meisol
7.1. Sailing Meisol may terminate the contract with immediate effect if:

  • The Participant falsely declares their health condition.
  • The Participant refuses to follow safety instructions or endangers others.

7.2. No refunds are issued if termination occurs due to the Participant’s misconduct.
7.3. The Participant bears all costs related to transport, accommodation, or alternative travel arrangements after termination.

8. Damage & Liability
8.1. The Participant is fully liable for any damage caused to the sailboats through negligence or intent.
8.2. Travel and liability insurance are strongly recommended.

9. Liability Limitations
9.1. Sailing Meisol is not liable for:
Weather-related changes, itinerary modifications, or discomfort due to sailing conditions.

Unavoidable port stays (e.g., for repairs, weather)..

Delays affecting return flights. Participants should allow at least 4 hours between trip end and departure flights.
9.2. Sailing Meisol is not liable for force majeure events (e.g., war, strikes, epidemics) occurring after contract conclusion.

10. Travel Documents & Health Regulations
10.1. The Participant is responsible for ensuring compliance with passport, visa, customs, and health regulations.
10.2. Sailing Meisol is not liable for any consequences resulting from the Participant’s failure to comply with these regulations.

11. Data Protection & Legal Jurisdiction
11.1. Sailing Meisol processes personal data in accordance with the Swiss Data Protection Act (DPA) and, where applicable, the General Data Protection Regulation (GDPR) for EU customers.
11.2. No verbal agreements exist. Any modifications to these GTC must be made in writing.

 

Final Notes

By registering, the Participant acknowledges the inherent risks of sailing and assumes full responsibility for their participation.

Participants are strongly advised to take out travel cancellation and liability insurance.

Effective Date: 01/04/2025
These General Terms and Conditions replace any previous agreements or versions.
